Terms & Conditions

By registering as an O’Briens Member (“Member”), you agree to the following Terms & Conditions:

1. Membership Eligibility

  1. Membership is open to individuals aged 18 years and above.
  2. Members below 18 years old may register with parental or guardian consent.
  3. Each individual is allowed one active membership account only. Duplicate accounts may be merged, suspended, or removed.

2. Membership Registration

  1. Members are required to provide accurate information including:
    • Full Name
    • Mobile Number
    • Email Address (optional but encouraged)
    • Date of Birth (for birthday rewards)
  2. O’Briens reserves the right to reject or terminate registrations containing false information.

3. Membership Benefits

Members may enjoy benefits including but not limited to:

  • Loyalty points accumulation
  • Birthday rewards
  • Member-exclusive promotions
  • Early access to campaigns or products
  • Discount privileges
  • Partner rewards and collaborations
  • Event invitations
  • Digital vouchers or coupons

Benefits may vary by campaign, membership tier, outlet participation, or promotional period.

4. Points Collection & Redemption

  1. Members may earn points from eligible purchases at participating O’Briens outlets.
  2. Points calculation rates will be determined by O’Briens and may change without prior notice.
  3. Points:
    • Have no cash value
    • Cannot be transferred to another member
    • Cannot be exchanged for cash
  4. Redemption is subject to:
    • Minimum points requirement
    • Product availability
    • Campaign conditions
  5. O’Briens reserves the right to adjust, reverse, or cancel points due to refund, abuse, fraud, or system error.

5. Membership Promotions

  1. Member promotions cannot be combined with selected discounts unless stated otherwise.
  2. Promotional offers:
    • Are subject to availability
    • May carry expiry dates
    • May be outlet-specific

6. Birthday Rewards

  1. Birthday rewards may only be redeemed during designated validity periods.
  2. Members must register birth details before qualifying for birthday benefits.
  3. O’Briens reserves the right to verify identity.

7. Digital Vouchers & Rewards

  1. Rewards issued through app, SMS, email, or QR voucher:
    • Are single-use unless stated otherwise
    • Cannot be replaced if expired
    • Cannot be exchanged for cash

8. Membership Expiry & Inactivity

  1. Membership may expire after prolonged inactivity determined by O’Briens.
  2. Unused points may expire according to programme policy.
  3. Members will be notified where reasonably possible.

9. Member Responsibilities

Members agree not to:

  • Misuse promotions
  • Create duplicate accounts
  • Engage in fraudulent transactions
  • Abuse staff or system loopholes
  • Resell rewards or vouchers

Violation may result in suspension or termination.

10. Account Suspension or Termination

O’Briens reserves the right to suspend or terminate membership if:

  • Fraudulent activity is detected
  • Terms are breached
  • False information is provided
  • Programme abuse occurs

Termination may result in forfeiture of accumulated benefits.

11. Privacy & Personal Data

By registering, Members consent to O’Briens collecting and processing personal information for:

  • Membership administration
  • Reward fulfilment
  • Marketing communications
  • Customer experience improvement
  • Promotional campaigns

Data handling shall follow applicable Malaysian privacy regulations and O’Briens Privacy Policy.

Members may opt out from marketing communications at any time.

12. Marketing Consent

Members may receive:

  • Email newsletters
  • Push notifications
  • SMS campaigns
  • Birthday messages
  • Promotions and partnership offers

Opt-out options will be provided where applicable.

13. Programme Changes

O’Briens may modify:

  • Membership structure
  • Points mechanics
  • Rewards
  • Benefits
  • Terms & Conditions

Changes take effect upon publication through official channels.

14. Limitation of Liability

O’Briens shall not be liable for:

  • Technical interruptions
  • System failures
  • Lost rewards due to incorrect member information
  • Third-party partner programme issues

15. Governing Law

These Terms & Conditions shall be governed by the laws of Malaysia.
